REGULAMENTO GERAL DE PASSATEMPOS
O presente Regulamento estabelece as regras gerais de participação nos passatempos organizados pela Bosch Portugal, pela Robert Bosch, S.A. sociedade anónima com sede em Avenida Infante D. Henrique, lotes 2-E e 3-E, registada na Conservatória do Registo Comercial de Lisboa, sob o número único de matrícula e de pessoa coletiva 500.233.179, com o capital social de EUR 259.000.000, doravante designada “BOSCH”.
A leitura e aceitação dos termos constantes do presente Regulamento Geral (doravante designado “regulamento” ou “regulamento geral”), não dispensam a leitura e aceitação do Regulamento Específico relativo a cada passatempo.
Em caso de divergência entre as disposições constantes do presente regulamento e o regulamento específico, prevalecerá o disposto no regulamento geral.
1. Passatempos
1.1. Designa-se por “passatempo” qualquer evento promocional promovido pela BOSCH nas suas páginas oficiais de com o objetivo de premiar participantes que cumpram na íntegra as suas regras e condições de participação.
1.2. A participação em qualquer passatempo pressupõe o conhecimento e a aceitação integral e sem reservas das condições deste Regulamento e seus eventuais aditamentos e modificações, bem como de quaisquer outras regras complementares contidas no regulamento específico de cada passatempo.
2. Condições de Participação
2.1. Qualquer pessoa singular, maior de 18 anos e residente em Portugal Continental ou nas Ilhas, poderá participar no passatempo.
2.2. Não é permitida a participação neste Passatempo a quaisquer colaboradores da BOSCH e demais empresas do grupo Bosch sedeadas em Portugal, seus familiares, agentes, parceiros e fornecedores, bem como a sociedades.
2.3. A BOSCH reserva-se o direito de analisar os elementos de identificação de todos os participantes dos seus passatempos, através do registo destes.
2.4. Sempre que solicitado pela BOSCH e dentro do prazo que a mesma venha a fixar para esse efeito, os participantes deverão provar que reúnem as condições necessárias de participação no passatempo, sob pena de desclassificação e anulação de quaisquer prémios que lhe tenham sido atribuídos. Caso os participantes não façam prova suficiente de que reúnem as condições necessárias de participação e os respetivos prémios já lhes tenham sido entregues, a BOSCH reserva-se o direito de exigir a sua devolução.
3. Participação
3.1. Salvo disposição em contrário constante de qualquer regulamento específico, a participação no passatempo está limitada a uma participação por pessoa.
3.2. Caso o mesmo participante apresente mais do que uma participação, será apenas considerada a sua primeira participação.
4. Meios de participação proibidos
4.1. Serão desclassificados do passatempo todos os participantes que apresentem as suas participações fora do prazo constante do regulamento específico; que não reúnam as condições necessárias de participação previstas no presente regulamento geral e/ou no regulamento específico de cada passatempo, bem como, aqueles que violem qualquer disposição daqueles regulamentos ou quaisquer disposições da legislação aplicável.
4.2. Serão, designadamente, desclassificados automaticamente os participantes que:
4.2.1. Recorram à criação de perfis fictícios, mediante recurso a endereços de emails fictícios ou a dados de registo falsos, imprecisos ou incompletos bem como, aqueles participantes, que recorram a estratégias e mecanismos impróprios para ganhar, nomeadamente, os participantes que recorram a mecanismos de manipulação ou supressão de dados através de programas informáticos ilícitos e que sejam suscetíveis de alterar quaisquer resultados, de forma a favorecê-los relativamente aos demais participantes;
4.2.2. Sobre os quais recaia suspeita de utilização de programas informáticos, ou quaisquer outros artifícios técnicos (vulgarmente designados por hacking ou cheating), permitindo participações automáticas ou de outro tipo para aumentar a pontuação;
4.2.3. Procedam à publicação de qualquer tipo de mensagem de spam (publicidade não desejada) ou provoquem qualquer tipo de flood (repetição de mensagens idênticas) no mural da página do passatempo;
4.2.4. Procedam à publicação de quaisquer comentários no mural da página do passatempo de índole religiosa, política ou étnica e/ou que utilizem linguagem obscena, insultuosa ou ofensiva.
4.3. Os fundamentos elencados no número 4.1, são-no a título meramente exemplificativo e, qualquer outro tipo de participação fraudulenta ou não, que viole a legislação aplicável, será imediatamente desclassificada
4.4. Em caso de desclassificação a BOSCH poderá recusar a atribuição do prémio, mesmo que o nome do participante tenha sido divulgado como premiado.
4.5. Nos casos previstos nos números anteriores a BOSCH eliminará do mural da página do passatempo todas as participações dos participantes desclassificados, reservando-se ainda o direito de excluir os participantes em causa do canal oficial da Bosch Portugal.
4.6. A decisão da BOSCH de desclassificação ou exclusão de alguma participação do passatempo é irrecorrível.
5. Prémios
5.1. O direito ao prémio de qualquer passatempo é pessoal e intransmissível, não sendo remível em dinheiro. O prémio não pode ser substituído por outro produto e é livre de qualquer encargo, sendo da responsabilidade da BOSCH o pagamento de impostos a que esteja sujeito.
5.2. O presente passatempo não é cumulável com outras promoções, ofertas e/ou campanhas em vigor nos estabelecimentos revendedores de produtos BOSCH.
5.3. Salvo disposição em contrário, o prémio encontra-se limitado ao stock existente.
5.4. O vencedor de qualquer passatempo não será ressarcido se, por motivos alheios à BOSCH, não puder usufruir do prémio que eventualmente lhe assista.
5.5. O não levantamento e/ou impossibilidade de entrega do prémio não imputáveis à BOSCH, no prazo que a mesma definir para o efeito no regulamento e, determinam para o vencedor, a perda de qualquer direito sobre o mesmo.
5.6. Os participantes autorizam a BOSCH a divulgar os seus nomes e o resultado dos passatempos na página oficial onde decorre o passatempo.
5.7. A seleção dos vencedores é feita por um júri eleito pela BOSCH, no uso do seu livre e exclusivo critério. Não há lugar a recurso das decisões do júri, que são definitivas.
6. Responsabilidade
6.1. Até à extensão máxima permitida pela legislação aplicável e, em caso de motivo atendível, a BOSCH poderá livremente e a todo o tempo, cancelar ou anular qualquer passatempo em curso, sem que desse facto resulte qualquer obrigação de indemnizar ou de compensar, por qualquer forma que seja, qualquer participante.
6.2. Todos os conteúdos disponibilizados pelos participantes no âmbito dos passatempos serão da exclusiva responsabilidade destes, pelo que em nenhuma circunstância poderá a BOSCH ser responsabilizada por aqueles conteúdos, bem como por quaisquer danos que os mesmos causem, designadamente, à imagem, reputação e/ou ao bom nome de terceiros.
6.3. A BOSCH não se responsabiliza, ainda, pela utilização, no âmbito dos passatempos, de qualquer conteúdo eventualmente protegido, designadamente, por direitos de autor, sendo a utilização destes conteúdos da responsabilidade exclusiva dos participantes.
6.4. A BOSCH não será igualmente responsável pela impossibilidade de participação em qualquer passatempo devido a falhas, erros de rede ou mau funcionamento do sítio eletrónico, nem se responsabiliza por quaisquer registos perdidos, atrasados ou não entregues a que estas anomalias deem eventualmente origem.
7. Dados pessoais
7.1. Ao participar no passatempo e em cumprimento da Lei nº 67/98, de 26 de Outubro, os participantes consentem no tratamento e processamento informático dos seus dados pessoais pela BOSCH. A omissão ou inexatidão dos dados fornecidos pelo seu titular são da sua única e inteira responsabilidade, tornando-se automaticamente inválida a sua participação no passatempo e consequente possibilidade de atribuição de prémio, sem que lhe seja devida qualquer indemnização.
7.2. Os participantes autorizam também, a transmissão dos seus dados pessoais a outras empresas do grupo BOSCH.
7.3. O tratamento de dados efetuado no âmbito do passatempo destina-se exclusivamente à gestão de participações, designadamente, para efeitos de registo dos vencedores de cada passatempo e respetivas classificações bem como, para efeitos de atribuição e entrega de prémios e de marketing.
7.4. Os participantes podem exercer os seus direitos de acesso, retificação, oposição e cancelamento, assim como revogar o consentimento dado para a comunicação dos seus dados e/ou o consentimento dado para a receção de comunicações comerciais através de carta registada com aviso de receção dirigida à Robert Bosch, S.A., EN 16 - Km 3,7, 3800-533 Cacia Aveiro, Portugal.
8. Propriedade Intelectual
8.1. O participante garante que é o único titular dos direitos de autor de todos os conteúdos que venha a disponibilizar no âmbito da sua participação e responsabiliza-se perante a BOSCH por este facto, podendo ser excluído se a BOSCH suspeitar que os referidos conteúdos não são da autoria do participante.
8.2. Os participantes autorizam expressamente a BOSCH a utilizar livremente todos os conteúdos que venham a disponibilizar no âmbito da sua participação designadamente, autorizam a BOSCH a reproduzir e/ou exibir quaisquer vídeos, imagens e/ou frases da autoria dos participantes em quaisquer comunicações, atividades publicitárias e/ou promocionais, destinadas a divulgar iniciativas organizadas pela BOSCH ou por quaisquer das sociedades suas associadas, sem que a esse título possa ser exigido à BOSCH qualquer remuneração, contrapartida ou qualquer compensação.
8.3. O participante reconhece e aceita que a sua participação é voluntária, cedendo expressa e irrevogavelmente à BOSCH- que os poderá ceder gratuitamente a outras empresas – todos os direitos sobre os conteúdos enviados no âmbito do passatempo, tendo tal licença carácter perpétuo e gratuito.
8.4. A BOSCH não se responsabiliza por quaisquer violações de direitos de autor e/outros atos ilícitos praticados pelos participantes no âmbito do passatempo.
9. Alterações ao Regulamento
9.1. A BOSCH reserva-se o direito de alterar, a qualquer momento e sem necessidade de pré-aviso, os termos constantes do presente Regulamento bem como, os termos de quaisquer regulamentos específicos dos passatempos por si organizados.
9.2. Quaisquer alterações efetuadas pela BOSCH aos regulamentos, entrarão em vigor, imediatamente após a sua publicação na sua página oficial e/ou na página do(s) respetivo(s) passatempo(s).
10. Outras disposições
10.1. A BOSCH não será responsável por quaisquer danos ou prejuízos que possam resultar da falha temporal de disponibilidade ou de continuidade do funcionamento do Passatempo, o defraudamento da utilidade que os utilizadores possam atribuir ao mesmo e, em particular, ainda que não de modo exclusivo, da falha de acesso ao endereço eletrónico indicado.
10.2. A Promotora não se responsabiliza pelo funcionamento da plataforma, nem pelos serviços de ligação à Internet ou de servidores de correio eletrónico.
11. Foro e legislação aplicáveis
11.1. Para a resolução de qualquer litígio emergente da execução, inexecução, incumprimento, interpretação ou integração do presente regulamento ou resultante da execução do passatempo, que não seja resolvido por mútuo acordo serão competentes os tribunais da comarca de Lisboa, com expressa renúncia a qualquer outro.

Bosch websites use the YouTube video platform operated by YouTube LLC, 901 Cherry Ave. San Bruno, CA 94066 USA. YouTube is a platform that enables playback of audio and video files.
When you load a page on our website, the integrated YouTube player establishes a connection to YouTube in order to ensure the technical transmission of the video or audio file. When the connection to YouTube is established, data is transferred to YouTube.

4) Twitter
Bosch websites use social plugins ("plugins") of the social network Twitter, which is operated by Twitter Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA ("Twitter"). The plugins are identified with a Twitter logo or the suffix "tweet".
If you visit a page on our website that contains such plugins, they are initially disabled. The plugins are not enabled until you click the button that is provided. By enabling the plugins, you establish the connection to Twitter and give your consent to the transmission of data to Twitter.
